These terms and conditions are intended to define the rights and obligations of the parties in the sale of goods proposed online by Special Expressions Ltd for the customer.
Before placing an order with Special Expressions Ltd, it is understood that you have read and agreed to these Terms and Conditions by ticking the Terms and Conditions box. These Terms and Conditions do not affect your statutory rights as a consumer.
All image, illustrations, text and designs contained within this website is property of Special Expressions Ltd and cannot be copied, published or used in any way without written consent from Special Expressions Ltd.
Copying of the product is strictly prohibited and legal action will be taken against any person(s) who do so.
Special Expressions Ltd reserves the right to make changes to this website and Terms and Conditions at any time. Prices and offers are valid for the day and time the site is consulted and is subject to change without notice.
Special Expressions endeavour to post out all orders within 3-5 working days of the order being placed. Due to all jewellery being handcrafted, delivery may take between 4-6 weeks if an item is out of stock at the time of ordering.
The website inventory is shared with our store and show inventory. Stock is adjusted manually and occasionally an overlap occurs between actual and listed stock, we apologise for any inconvenience this may cause if an item becomes out of stock, we will immediately contact you and advise on an alternative design or an expected delivery date.
Retail orders over £125.00 in the UK receive free delivery and postal insurance.
Retail orders over £250.00 internationally will receive free delivery.
For orders under £125;
Royal Mail Special Delivery - £6.50
Royal Mail 1st Class Post - £3.50
For orders consisting only of Earwraps/Earcuffs will be sent Royal Mail 1st Class Post - £1.60
International Insured Postage - £15.00
Special Expressions Ltd recommends that you use Royal Mail Special Delivery as it includes insurance. If you do not choose to have your jewellery sent by the insured method then Special Expressions Ltd will NOT accept responsibility for items lost in the post. We obtain proof of postage for every order.
Special Delivery includes insurance of your products up to £500. This method of postage insures your jewellery against loss or damage, but we do not guarantee next day service from the date of placing your order. If using Special Delivery, Royal Mail will leave a card if you are not available to accept the delivery of your goods. Please follow the re-delivery instructions. Should these instructions not be followed, the parcel will be returned to Special Expressions Ltd and in these circumstances, you will be required to pay the re-delivery charges before we attempt to re-deliver the items to you.
For orders delivered to the rest of the world
Once payment has been received, the product will be posted within 3-5 working days using Insured Postage. If you need an item urgently, please contact us at email@example.com and we will give you an estimated delivery time.
Lost or Damaged Packages
All products leave our premises in perfect condition. When using Royal Mail Special Delivery, the customer must notify the postman of even the slightest trace of damage (holes, signs of crushing, etc) to the parcel and refuse the package if necessary. No exchanges can be made at a later time for goods claiming to be damaged during carriage without notification at the time of receiving the goods.
We will NOT be held responsible for delayed delivery times due to the carrier, including the loss of goods, due to bad weather or strikes.
The customer must inform Special Expressions Ltd immediately if there has been an error in the address when placing the order. The customer must also inform Special Expressions Ltd concerning any claim of delivery error or non-conformity of goods, in kind or quality, compared with the information on the purchase order.
Neither party will be deemed to be in breach of any of its obligations under the agreement as a result of any delay in performing or any failure to perform any such obligations by reason of any cause or event beyond the parties' control. A force majeure event includes, but is not limited to, any unforeseeable, inevitable, or unstoppable act, event, non-happening, omission or accident beyond the control of either party, despite all reasonable efforts made to the contrary. In addition to events usually recognized by the British courts, a force majeure event includes in particular (without limitation) the following: Strike, lock-out, earthquake, fire, storm, flood, lightning, explosion, impossibility of the use of public or private telecommunications networks.
Proof of Transaction Data Protection
Any personal data obtained by Special Expressions Ltd in your use of our site will be recorded electronically and only used in accordance with the UK Data Protection Act 1998. We will not disclose your details to any third parties without your consent. Any information collected will be use to process your order and to provide you with our best possible service. If you have ticked the information opt out box, Special Expressions Ltd will not e-mail you with future offers. The type of information we will collect and will be kept up to date and includes: your name, address phone number, email address. We do not keep any credit card information on our systems.
UK consumers have the right under the Consumer Protection (Distance Selling) Regulations 2000 to cancel their order within a "cooling off period" which concludes 7 working days from the day after taking delivery. Cancellation, must include your order number, your full name and address, and be in the form of email or letter and be sent to our address as listed on the contact page of this site. If you cancel your order under the "cooling off period” then you will be responsible for returning the goods to us, otherwise you will be responsible for paying our costs in recovering the goods. You must make sure that the goods remain undamaged and unused and in saleable condition to be entitled to any refund. The delivery of the goods to you is a separate contract for services and is not covered by the cooling off period; therefore any refund made will not include the costs of delivery of the goods to you.
Exchange & Refund Policy
Please note that, in compliance with the UK's Health & Hygiene regulations, Special Expressions Ltd cannot accept the return of earrings or Earspirals unless they were originally faulty. Please inform us by email, firstname.lastname@example.org, stating your reasons if you are not satisfied. All items returned must be in perfect condition in the full original packaging together with the receipt. Return postage to be paid by customer & sent by Royal Mail Special Delivery. Please send returns to: Special Expressions Ltd, 34 Main Street, Keswick, Cumbria, CA12 5JD. We regret that we cannot accept returned goods without first being contacted in writing or via e-mail. On receipt of goods we will offer you a replacement or a gift voucher to the value of the returned items. Should you need to return an item after the 7 day "cooling off" period but before 28 days have passed, contact the company in writing and at the company’s discretion a replacement or gift voucher may be issued.
Applicable Law and Competent Jurisdiction
In form and content, these Terms and Conditions shall be governed by and construed in accordance with English law. All orders placed on www.specialexpressions.co.uk strictly imply the acceptance of Special Expressions Ltd's terms and conditions.
In case of dispute or claim, the customer agrees to seek an amicable solution with Special Expressions Ltd before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
